Plain versions of the terms that matter. A full agreement is provided before any paid engagement begins.
What we provide
Accessibility testing, remediation, monitoring, reporting, a published statement, a barrier-report channel, and a visitor preferences widget, according to the plan you are on.
What we do not warrant
We do not warrant that your site conforms to WCAG, the ADA, the European Accessibility Act, or any other standard or law, and we do not warrant that you will not be the subject of a claim. Conformance is a property of a website at a point in time and it changes with every deploy, every new page, and every piece of content anyone on your team publishes.
What we do commit to is performing the testing and remediation described in your plan competently, reporting findings accurately, and telling you plainly what has and has not been tested.
Things outside our control
Unless your agreement says otherwise, we are not responsible for content you or your users publish after our work, third-party embeds, plugins, and scripts on your site, PDFs and other documents, media without captions or transcripts we did not produce, or changes made by others to code we remediated.
Your responsibilities
Give us accurate access to what needs testing, review and deploy fixes in reasonable time, and tell us about significant changes to your site. Monitoring cannot catch what it is not pointed at.
Ownership
Fixes we write into your source are yours. Reports, scan data, and your remediation history are yours and exportable at any time. Our widget, platform, and scanning software remain ours and are licensed to you for the term of your subscription.
Billing
Subscriptions are billed monthly in advance through Stripe and can be cancelled at any time, effective at the end of the current period. Remediation projects are quoted in writing and invoiced separately. We do not issue refunds for elapsed subscription time.
Exceeding a plan's widget load allowance never affects your live site. It pauses reporting in your dashboard until the plan is adjusted.
Liability
Our aggregate liability is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential loss, including legal costs arising from third-party claims about your website.
Ending the agreement
Either side may end a subscription with 30 days' notice. On termination you keep everything already delivered, and we will export your data on request. Fixes already written into your source stay yours and keep working.
